1.1 This privacy policy (“Privacy Policy”) applies to your use of the domain name www.benefitscircle.com owned and operated by Marsh India Insurance Brokers Private Limited, an insurance broker - composite registered with the Insurance Regulatory and Development Authority of India bearing Registration No. 120 (hereinafter, referred to as “Marsh India” or “We” or “Our” or “Us”).

1.2 The domain name and the mobile application are collectively referred to as “Website” which is a platform that facilitates solicitation and servicing of insurance policies of various insurance companies, and offers claims consultancy, risk management services and any other services as permitted under applicable law (hereinafter collectively referred to as “Services”).

1.3 This Privacy Policy applies to such natural persons who are merely visitors on the Website, prospective customers through the use of the Website, as well as any existing customers who have agreed to obtain the Services (hereinafter, referred to as “You” or “Your” or “Yourself” or “User”).

1.4 This Privacy Policy describes Marsh India’s practices in relation to the collection, use and sharing of certain information, including Personal Information provided by You on Your access/use of the Website or otherwise, in connection with the Services offered to You. In this regard, please note that the term “Personal Information” refers to information relating to a natural person that is capable of identifying such person and includes any sensitive personal information.

1.5 This Privacy Policy is published in accordance with the Information Technology Act 2000 and Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, as amended from time to time.

1.6 Marsh India is committed to maintain confidentiality, integrity and availability of all information it collects from the Users. In this regard, We have implemented reasonable security practices and procedures that are commensurate with the information assets being protected and with the nature of Our business per applicable law (as amended from time to time), such as the IRDAI’s Guidelines on Insurance E-commerce of 9 March 2017 and the IRDAI’s Information and Cyber Security Guidelines 2023 of 24 April 2023.

1.7 Please read the Privacy Policy carefully before proceeding to use the Website. By using the Website, You agree to be legally bound by the terms and conditions of this Privacy Policy with immediate effect. If You do not agree, then please do not continue to access or use the Website, and do not complete any registration process available on the Website.

2. Type of Information Collected

2.1 Marsh India primarily collects Your information including Personal Information when You access/use the Website, or register for an account, or when You obtain the Services.

2.2 Personal Information: As a part of the registration process, Marsh India may collect certain categories of Personal Information from You such as Your name, age, date of birth, gender, email address, phone number, residential address, username and password. We may also collect Your information, including any Personal Information, if You participate in any promotional activities organised by Us (such as surveys, competitions and seminars), sign up/subscribe for Our promotional materials, or contact Us by phone, email or through the Website.

2.3 Sensitive Personal Information: In order to obtain the Services, We may also collect certain categories of sensitive personal information from You such as financial information (including Your bank account details), health conditions (physical, physiological and mental), medical records and history, biometric information (such as fingerprints), etc.

2.4 Browsing Data: We may also receive and/or hold information about Your browsing history, Internet Protocol (IP) address of Your electronic device (or the proxy server), operating system, type of web browser, language, time zone, region and other specifications of Your electronic device (ie, mobile and personal computer) for anonymous statistical purposes including advertisements, administration of the Website and associated servers, and to improve the Services.

3. Consent and Right to Amend

3.1 All the information including Personal Information provided to Marsh India by You is voluntary.

3.2 If You do not wish to provide Your Personal Information requested or allow use of Your Personal Information, You may withdraw Your consent for use of the Personal Information collected. If You choose to withdraw consent, Marsh India reserves the right not to provide the Services or to withdraw the Services for which the information was sought/collected from You. However, please note that any withdrawal of Your consent shall not be treated on a retrospective basis.

3.3 You have a right to access, modify, correct or delete any Personal Information provided by You voluntarily, and collected by Marsh India in accordance with this Privacy Policy. However, if You update Your information, Marsh India may keep a copy of the older information in its archives.

4. Age of Consent

4.1 By using the Website, You represent that You are at least the age of majority in Your state or province of residence and You have given Us Your consent to allow any of Your minor dependents to use this site.

5. Purpose for Collecting Information

5.1 Marsh India uses, stores and/or transfers Your information collected, including Personal Information, for purposes necessary for performance of the Services (online or offline) sought by You and to improve and develop any existing and new services.

5.2 We also use Your Personal Information when it is necessary for purposes directly or indirectly related to the Services, such as the performance of obligations under any agreement with Our third-party service providers (such as logistic services, marketing and advertising services, payment gateways, etc).

5.3 We use Your Personal Information to carry out various activities connected with the running of Our business such as data analysis, market research and product development, personnel training and educational programmes, internal management processes (such as audit, accounting, etc) and as otherwise provided in this Privacy Policy.

5.4 In addition, Marsh India uses Your Personal Information to contact You by email, phone call or SMS and deliver information targeted to Your interests, such as banner advertisements, newsletters, promotional offers, notices, communications, etc, relevant to Your interests and use of the Website. By accepting this Privacy Policy, You expressly agree to receive such information and communications. In case You do not wish to receive such information and communications, then We request You to kindly unsubscribe/opt out of the receipt of such information and communications.

5.5 We use Your Personal Information where We need to comply with Our obligations under applicable laws.

5.6 We use Your Personal Information only for the purposes as set out above. We may use Your Personal Information for purposes other than those set out above provided the purpose is necessary and related to the above purposes. 6.1 Marsh India treats Your Personal Information and Your use of the Services as private and confidential and does not disclose Your Personal Information to third parties, except as may be as authorised by You, or as may be necessary to provide the Services, including under the following specific circumstances:

  1. to insurance companies chosen by You for the purpose of facilitating sale and servicing of insurance policies and the filing of insurance claims;
  2. to third party service providers appointed by Us for the purpose of carrying out the Services on Our behalf under contract;
  3. to government institutions or authorities to the extent required
    (i) under any laws, rules, regulations and/or under orders of any relevant judicial or quasi-judicial authority;
    (ii) to protect and defend the rights or property of Marsh India;
    (iii) to fight fraud and credit risk;
    (iv) to enforce Marsh India's Terms of Use (of which this Privacy Policy is also a part); or
    (v) when Marsh India, in its sole discretion, deems it necessary in order to protect its rights or the rights of others;
  4. if otherwise required by an order under any law for the time being in force including in response to enquiries by government agencies for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences;
  5. to another entity in case Marsh India is acquired or merged with the entity, and in such case, the privacy policy of the acquiring party shall subsequently govern all such Personal Information that has been transferred.

6.2 Information which is not in the nature of Personal Information may also be disclosed to third party advertisement companies/agencies, third party servers, technology vendors and research firms to serve advertisements to the Users.

6.3 Marsh India may also share general statistical information of its Users and Services to prospective investors, strategic partners, sponsors and others in order to aid the growth and development of Marsh India’s business.

7. Retention

7.1 Your Personal Information will not be stored for a period longer than is required for the purposes for which it is collected or required under any applicable law.

7.2 We may also continue to store Your Personal Information in anonymised form and non-personally identifiable format for analytical and research purposes.

8.1 On the Website, if permitted by applicable law, certain links to third party websites may be provided which are operated by the third parties, including by insurance companies, and are not controlled by, or affiliated to, or associated with Marsh India unless expressly specified on the Website. 8.2 We are not responsible for the policies or practices of such third-party links and accordingly We do not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor do We guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites.

9. Payment related information

9.1 All payment transactions happen using secure server software through third party payment gateways engaged by either Marsh India directly or by other third parties, including insurance companies. Marsh India does not have end-to-end control over such transactions and shall in no way be responsible or liable for any loss or damage due to any disclosure of Your payment related information.

9.2 Marsh India hereby disclaims all its liability and shall in no way be liable or responsible for any loss or damage caused to You on account of intentional or unintentional disclosure of any Personal Information concerning Your account and/or any information with respect to any online payment transaction handled by third party payment gateways using the credit card/debit card/cash card/net-banking/mobile wallet/UPI etc, and/or the payment verification process.

10. Security

10.1 Marsh India takes all reasonable steps to comply with applicable laws to ensure that the Personal Information provided by You is stored in a secure environment protected from unauthorised access, modification, destruction, or disclosure. In this regard, We have adopted reasonable security practices and procedures to include, technical, operational, managerial and physical security control measures that are commensurate with information assets and with the nature of business.

10.2 Marsh India takes adequate steps to ensure that third parties to whom Users’ Personal Information, including sensitive personal information, may be transferred adopt reasonable level of security practices and procedures to ensure security of Your Personal Information. However, We cannot guarantee absolute security of Your Personal Information and shall not be liable for any breach of security by an outside third party.

10.3 You are responsible for maintaining confidentiality and security of Your username and password and may not disclose these credentials to any third party.

11. Modification

11.1 Marsh India reserves the right to change or modify this Privacy Policy, in whole or in part, with or without prior notice, from time to time. Users are encouraged to periodically review the Privacy Policy.

11.2 Any changes to the Privacy Policy will become effective upon posting of the revised Privacy Policy on the Website. Access or use of the Website following the posting of the Privacy Policy will be considered as Your acceptance of the revised Privacy Policy. 12.1 This Privacy Policy shall be governed by the laws of India. Any and all disputes arising under or in relation to this Privacy Policy shall be subject to the exclusive jurisdiction of courts in India
